GENERAL TERMS AND CONDITIONS

1. Scope

These terms and conditions apply to all contracts between Klaus Hölzle, Bänschstr. 41, 10247 Berlin, and his clients, unless expressly agreed otherwise or as required by law. The client acknowledges the terms and conditions to be binding by awarding the contract. Changes, additions and ancillary agreements must be in writing.

2. Rates

The fees quoted on this web site cover all my services, including any related costs for office supplies, postage, maintenance of computer equipment with peripherals and telecommunications.

The minimum order value is € 35.00 plus VAT.

For translations that need to be delivered within 8 hours, a rush premium of 15% will be charged. For work done between 18:00 and 08:00 or at weekends a supplement of 25% will be charged.

VAT of 19% is added to all prices.

3. Orders

Each order from the client must be confirmed in writing by me in order to be valid. No claims shall arise against me in respect of obvious errors or spelling/numerical errors. All orders are carried out with due care and attention and in accordance with the general customs and practices of the trade. The order shall be carried out as agreed in the contract and shall be sent to the client.

4. Delivery

Delivery shall take place by e-mail, or (subject to prior agreement) by fax, post, messenger or delivery in person.I am not liable for any loss, damage, or distortion of data that may occur during electronic transfer. The client shall be responsible for the final verification of all files. This verification shall not give rise to any claims for damages.

5. Rectification of errors

I reserve the right to rectify any errors. The client may request that any errors appearing in the service provided be rectified. Any claim for rectification of errors must be made by the client within two weeks of the translation being submitted and must include precise details of the errors in question.

6. Confidential treatment of documents

I undertake to maintain confidentiality in respect of any facts that come to my knowledge through my work for the client and to deny third parties access to such facts. Notwithstanding this, absolute data protection during electronic file transfer cannot be guaranteed.

7. Payment

My invoices are payable by bank transfer in one instalment without deduction on the date for payment specified on the invoice. Any bank charges and fees for foreign transfers shall be borne by the client.

8. Retention of title

Property in the translation delivered shall remain with me until payment has been made in full.

9. Applicable law

All orders and claims arising out of them shall be governed by German law. The place of performance and the applicable jurisdiction for both contractual parties shall be Berlin.
